The main topic for copyright is the unanswered question of the copyrightability of illegal works, such as graffiti, which remains unanswered by the law. For VARA, we are trying to find out if ‘temporary’ and possibly illegal designs that are attached to property can be sold, enjoyed, or possibly halt new constructions. Based on this background, Fake Estates LLC creates and sells GPS-augmented reality nfts that are only accessible within and around overly priced real estate, publicly owned private spaces, vacant lots, and the moon. In this space, I am exploring the conversation the Supreme Court is not having with the 9th Circuit’s decision, Perfect 10 v. Amazon, declaring search engine imagery as transformative fair use, and the writings of Hito Steyrel in relation to deteriotaion of legibility.&nbsp; My recent solo exhibition, “thumbnail”, examines this by merging thumbnail low-resolution images with painting, collage, multiples, and artificial intelligence as an evidentiary tool. From this space, I am moving forward with the limitation of only utilizing low-resolution imagery as a form of new language within art and law to test the boundaries of technology, art, design, and project that is turning the Supreme Court, 2nd Circuit Judge Gerard Lynch, and Attorney Lisa Blatt into various Andy Warhol derivatives.&nbsp;Some of the images are created via photoshop while others are created using Dall-e 2.0 artificial intelligence. But, all are placed into an editorial design that slightly changes. One of the goals for all of these derivatives is to find the point of fair use. As of 10/14/22, the case between the Andy Warhol Foundation and Lynn Goldsmith is before the Supreme Court. These photographs were taken through a peephole installed within a reflective box that peers into the social media accounts of multiple celebrities.&nbsp; They show glimpses of celebrity life while individuals in quarantine try to mirror these emotions to feel the leisure of celebrity. This leisure is an unattainable microcosm surrounded by infinite dead space. Intended to purposefully infringe on celebrity images, “Right of Publicity” uses amorphous non-copyrightable materials: mirrors, reflection, and light, to commercially infringe upon the protected amorphous identity of celebrity. As “Right of Publicity” is intended to be a clear case of copyright and identity infringement, the case examines:(1) if amorphous light/identity can be copyrighted, (2) are the materials and subject matter transformative enough for fair use analysis, (3) can commenting and critiquing the law be a form of fair use, and (4) in the analysis of fair use which is more important, the purpose and the character of the use or the effect upon the marketplace. While this case study questions time-based materials, such as light, for copyrightability, transformativeness, and fair use; it also addresses the paramount question if courts grant deferential treatment in fair use to celebrity economics&nbsp; (e.g., newsworthiness protections for paparazzi/tabloids and intellectual property protection for identity) over artistic free speech in remix/appropriation culture. Rockefeller, into delusional acceptance of their wealth and the steps taken to achieve it without remorse. As Rockefeller states: “The growth of a large business is merely a survival of the fittest… The American Beauty Rose can be produced in the splendor and fragrance which brings cheer to its beholder only by sacrificing the early buds which grow around it. This is not an evil tendency in business. It is merely the working-out of a law of nature and a law of God.” Ironically, these industrialist barons would destroy the beauty of nature for their quest of economic divinity. Those who dissented to the “law of nature” were seen as “social meddlers”. These reformers were viewed as delusional laborers that did not believe in the survival of the fittest, and wanted to create an artificial world of glee. In Sumner’s view “the social meddlers had been laboring under the delusion that, since there are no natural laws of the social order, they might make the world over with artificial ones… to remake it with their petty desires…with the premise that “everybody ought to be happy”.Here in the 21st century, we still have robber barons destroying the beauty of nature for their quest of economic divinity. They still sacrifice the laborers through the union-busting activities of Google, Amazon, Tesla, and Facebook. While the physical world is in shambles from the previous hereditary wealth wreath, the new Social Darwinists look towards the stars and the artificial.Sumner’s quip on laborer’s creation of an artificial utopia where “everybody ought to be happy”, could have existed with open-source/public domain technology such as, three.js, ar.js, which revolted against natural rights. However, the barons have invaded. This work is hosted on Facebook’s (or “Meta’s”) SparkAR platform. These augmented or artificial experiences are sacrificial buds.
